Where is all this coming from? buyers may or may not have heard about the new Buyer Agent Agreement rules in Massachusetts ( and Nationwide ) required of the National Association of REALTORS ( NAR ) settlement, but there is a LOT of misinformation out there. Predictably, there are a lot of agents taking advantage of the confusion. We aim to clear that up so that buyers can be informed and protect themselves.
As of August 17th, 2024 the NAR requires:
Buyers' agents must now enter into a written buyer agreement before touring a property with a prospective homebuyer.
This puts buyers into a difficult position. How do you see a home without getting locked in to a bad agreement with an agent you may or may not want to work with?
First and foremost – it’s more important than ever to engage an agent at the beginning of your search… get referrals from friends, family or do your own research for agents in your desired location and interview them to see if they are a good fit for you and your search. If you DO tour a home before hiring your agent, although an agreement is required, there is no set timeframe or compensation… so if you have not already hired an agent you are comfortable with, you can and should insist that the agent agree to show you the home on a very limited basis ( can be for 1 day, just for that particular home etc ). This way you can see how you and the agent work together before deciding on a more comprehensive representation agreement.
We have already heard some horror stories of agents locking buyers into 1 yr or longer terms for very high rates and the buyer finding out they do not work well together, only to find they are locked in to paying that agent if they buy a home… ANY home in any capacity.
